Should the Father of 13 Years Old Boy who Drove a Car and Killed 7 People in a Car Accident Responsible with his Son’s Action?

Sunday, 8th September 2013, 00:45. A 13 years old boy was driving a car in the highway (Jakarta-Bogor) after he brought back home his girlfriend in Bogor. The driver drove in the over the speeds limit and hit a traffic barrier. Then the car jumped over the barrier to the opposite direction of the highway, and hit a minibus. He killed 7 people and hurts the other 10 people. But the question is, should the father of 13 years old boy who drove a car and killed 7 people in a car accident responsible with his son’s action?

Personally, I agree with it. The father should responsible with it. In Indonesia, children’s rights are quite protected. So, the kid will also do the punishment, but only the half of it while his father will do the rest. Quite fair, isn’t it? But, the problem is we are not finding justice, but finding who should responsible to the action, is it the son or the father. But from my opinion, the father should responsible with it.

The first reason, the father should responsible because he allowed his son to drive and know that his son can drive, but the father never taught him how to drive and he doesn’t know where the kid learned to drive. As a rule, the father should be able to teach his kid to drive, even if the kid can drive. Because the father should know how aware he is to the traffic.

The second reason, a driver should have a license to drive. As a rule, to get a driving license, the driver should be at least 17 years old. Because the kid is still 13 years old, so do not ask that he have a license. The answer will always be ‘No’ before he is at least 17 years old. Why it’s should be 17 years old to get a license drive? Because to drive, a driver should be at least can control his/her emotion. 17 years old is the age when a person can be mature. So, to get a license and drive, maturity is needed.

Others may argue that it’s unfair because the kid is the one should responsible with his action. I understand this point of view. But however, the kid is still 13 years old, a puberty age. He doesn’t even have a citizenship card and license. He still lives with his father. And because it’s also his father’s fault, so he should also responsible with his son’s action. But it doesn’t mean that the driver shouldn’t responsible. The driver should also responsible with his action.


So, the conclusion is, the father of 13 years old boy who drove a car and killed 7 people in a car accident should responsible with his son’s action. Because it’s also his father’s fault to let him drive…
